Terms & Conditions

Welcome to NuGo. These Terms & Conditions ("Terms") govern your use of the NuGo mobile application and related services (the "Service"), operated by NuGo, developed by Dr Deirdre Ryan, Clinical Psychologist ("we", "our", or "us"). By creating an account or using the Service, you agree to these Terms.

1. About NuGo

NuGo is a support and wellbeing app for parents and carers of children with autism, ADHD, and other neurodevelopmental needs. It provides guided tools, calming strategies, organisational features, and educational content.

2. Eligibility & Accounts

• You must be at least 18 years old to create an account. NuGo is designed for use by parents, carers, and educators — not by children.
• You are responsible for keeping your login details secure and for all activity under your account.
• You agree to provide accurate information when creating your account.

3. Subscriptions & Free Trial

• NuGo is a subscription service. New users receive a one-month free trial with full access to all features.
• After the free trial, continued access requires a paid subscription, billed through your App Store or Google Play account.
• Unless cancelled at least 24 hours before the end of the trial or current billing period, your subscription renews automatically and your store account is charged.
• You can manage or cancel your subscription at any time in your App Store or Google Play subscription settings. Cancelling stops future charges; you keep access until the end of the paid period.
• Prices are shown in the app before purchase and may vary by region. Any price changes will be communicated in advance and apply from the next billing period.
• Refunds are handled by Apple and Google under their respective store policies.

4. Your Content

• You retain ownership of all content you add to NuGo (e.g., Child Passport details, documents in the Lock Box, notes, and check-ins).
• You grant us the limited licence needed to store, process, and display that content solely to provide the Service to you.
• You are responsible for the content you upload and must have the right to store and share it.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in a way that could harm others;
• Attempt to gain unauthorised access to the Service, other accounts, or our systems;
• Copy, modify, reverse-engineer, or resell the Service or its content;
• Upload malicious code or content that is unlawful, harmful, or infringes others' rights.

6. Intellectual Property

The NuGo app, including its design, text, graphics, illustrations, and software, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

7. Privacy

Your privacy matters to us. Our Privacy Policy explains what data we collect and how we use it, and forms part of these Terms. You can delete your account and data at any time — see our Account Deletion page.

8. Availability & Changes to the Service

We work hard to keep NuGo available and improving, but we cannot guarantee uninterrupted access. We may add, change, or remove features from time to time. If we make material changes that reduce the Service, we will give reasonable notice where practicable.

9. Disclaimer & Limitation of Liability

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, and we are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence. Our total liability to you is limited to the amount you paid us in the 12 months before the claim arose.

10. Termination

You may stop using NuGo and delete your account at any time. We may suspend or terminate accounts that breach these Terms. On termination, your right to use the Service ends; provisions that by their nature should survive (e.g., intellectual property, limitation of liability) will survive.

11. Governing Law

These Terms are governed by the laws of Ireland. Any disputes will be subject to the non-exclusive jurisdiction of the Irish courts. If you are a consumer in the EU, you also benefit from any mandatory protections of the law of your country of residence.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app and update the "Last Updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
